The conditions for debt collection depend on whether the debt is collected in Lithuania or abroad, the age of the debt, the size of the debt, and the debtor (B2C or B2B). The service fee for debt collection (from entities operating in Lithuania) is only applicable if the collection is successful and the debt is older than 90 days.
No. If needed, certificates of uncollectibility are issued.
Pre-litigation debt collection is the process of informing the debtor about an unpaid debt and urging them to settle it without court intervention. This is often done through various communication channels such as SMS messages, phone calls, emails, postal letters, and more. This process allows the creditor to quickly and efficiently initiate debt collection without court intervention, saving time and costs.
Litigation debt collection is the process that begins when the debtor fails to pay the debt despite reminders and notifications. It is the last resort a creditor can take to recover the debt. This process involves the following main steps:
- Filing a lawsuit: The creditor or their authorized representative files a lawsuit in court to claim the debt. The court reviews the case, assesses the arguments, and makes a decision regarding the debt repayment.
- Debt adjudication: If the court decides that the debtor must pay the debt, it issues a court order. This order specifies the amount of debt that the debtor must pay to the creditor.
- Enforcement: If the debtor does not pay within the term specified in the court order, the creditor can initiate the enforcement process by transferring the debt to bailiffs. The bailiff will take necessary measures, such as freezing bank accounts or seizing assets, to recover the debt.
